現在マレーシアでは、11人のウイグル人難民が、事実上中国に強制送還される危機に陥っています。それに対し抗議する文章を世界ウイグル会議が発表しましたので(2月14日)その翻訳と英語原文を紹介します。

　中国新疆ウイグル自治区に住むウイグル人の権利を代表する国際的な組織である組織(世界ウイグル会議)の代理として、私はこの手紙を書いています。
　ウイグル人コミュニティの代表として、現在マレーシアで拘禁されている11人のウイグル難民の国外追放を中止することを強く要請します。私たちは、彼らの生命を救い、彼らが安全な第三国に落ち着くことを見届けるために、マレーシア政府に対して人道的配慮を求めています。中国政府が難民を彼らに引き渡すようにマレーシアに圧力をかけてくるであろうことを私たちは理解していますが、これらの11人の生命がかかっているので、簡単に判断すべき問題ではありません。

　私たちはこの状況の深刻さを強く主張しなければなりません。これらの11人の人々はもし中国に強制送還されたら、公正な裁判を受けることができず、司法制度を活用することもできなくなるでしょう。代わりに、彼らはきっと中国で拘禁されている間に、恣意的拘束、強制的失踪や拷問にかけられることでしょう。世界ウイグル会議では、過去20年間において、300件以上の中国に引き渡されたウイグル人の事例を文書化しており、マレーシアの事例も数件含まれています。こうした事例の大部分において、私たちは彼らがその後どうなったのか消息がつかめていません。マレーシア政府がこれらの難民を引き渡せば、それは死刑宣告を下したのと同じです。
　私たちがマレーシア政府に対して理解していただきたいのは、拷問、強制的失踪、恣意的拘禁など人権侵害の重大な危険にさらされる国に、このウイグル人たちを送り返すことは、国際法と人権規範に違反するだけでなく、 道徳的に間違った行動であるという点です。

　これらの11人はより良い人生を求めて中国から逃れ、信じている宗教を理由に迫害を受けたり、民族的アイデンティティを理由にした差別を受けることのない生活を送りたいのです。彼らはそのために、司法制度を利用することなく、つねに強制送還の脅威に晒されながら、タイに4年間近く拘禁されました。私たちは政府に対して彼らにこれ以上の苦しみを与えないでほしいと要求します。
　これらの人々は父親であり、夫であり、兄であり息子です。もしマレーシア政府が彼らを中国に引き渡せば、これら11人の人生が壊滅的なダメージを受けるのみにとどまらず、彼らの家族や愛する人達やウイグル人コミュニティ全体に打撃を与えることになります。

　詳細な調査は、これらの人たちが何も間違ったことをしていない点がはっきりさせることを私たちは政府に保証します。中国政府は、以前から引き続いて、彼らが信じている宗教を理由に、罪のないウイグル人の人たちに「テロリスト」であるというレッテルを貼ろうとしていますが、この告発にはそれを証明する何の証拠もありません。

　私たちは、マレーシア政府が国際人権規範を遵守し、ウイグル人を中国に送還しないでほしいと、再度嘆願いたします。

I am writing on behalf of the (ORGANIZATION) in (LOCATION), an international organization representing the collective interests of the Uyghur people living primarily in the Xinjiang Uyghur Autonomous Region of China.

On behalf of the Uyghur community, we urge you to halt the deportation of 11 Uyghur refugees currently in custody in Malaysia. We appeal to the humanity of the Malaysian government to save their lives and ensure they are resettled in a safe third country. We understand that the Chinese government is likely applying pressure to Malaysia to return the refugees, but this decision must not be taken lightly as the very lives of these 11 people are at stake.

We must stress the seriousness of this situation. If deported to China, these 11 people will have no fair trial and no access to justice. Instead they will likely be subjected to arbitrary detention, enforced disappearance and torture in Chinese custody. Over the last 20 years, the World Uyghur Congress has documented over 300 cases of Uyghurs having been extradited to China, some from Malaysia. In the vast majority of these cases, we never hear from them again. If the Malaysian government extradites these refugees, it stands as a death sentence.

We would like to remind the Malaysian government that sending anyone back to a country where they would be at significant risk of torture, enforced disappearance, arbitrary detention and other serious violations of human rights is not only a violation of international law and human rights norms, but a morally wrong action.

These 11 people fled China in search of a better life, where they could practice their religion without persecution and live their lives free of discrimination on account of their ethnic identity. For their efforts, they were detained in Thailand for nearly four years with no access to justice and under a constant threat of deportation. We ask you to please not inflict more suffering on them.

These people are fathers, husbands, brothers and sons. If the Malaysian government hands them over to China, not only will the lives of these 11 people be irreparably damaged, it will also devastate their family and loved ones and the entire Uyghur community.

We assure you that a detailed investigation should clear these individuals of any wrong doing. The Chinese government has consistently tried to label innocent Uyghurs as ‘terrorists’, given their religious backgrounds, though no evidence has been presented to support this accusation.

We, members of the Uyghur community, once again implore the Malaysian government to support international human rights norms and ensure that the Uyghurs are not returned to China.
